Welcome to YP Health and Fitness. These Terms and Conditions govern your membership and use of our facilities. By signing up as a member, you agree to the following:
1. Membership and Access
1.1 Membership grants you access to YP Health and Fitness, located in Minlaton, including 24/7 access unless otherwise specified.
1.2 Members must use their assigned swipe pass to enter the gym. Entry records will be maintained for at least three (3) months.
1.3 Membership is non-transferable. Members must not allow others to use their swipe pass or provide access to non-members.
1.4 Members under the age of 18 are not permitted to access the gym during unstaffed hours.
1.5 Lost or damaged swipe passes must be reported immediately, and a replacement fee may apply.
1.6 YP Health and Fitness reserves the right to revoke access for any breach of these Terms and Conditions.
2. Induction and Equipment Use
2.1 All members must complete an induction session to ensure they understand the safe and proper use of equipment.
2.2 Members are responsible for booking their induction session by contacting admin@yphealthandfitness.com.au.
2.3 Members must sign a waiver acknowledging their understanding of equipment use and the risks associated with gym activities in compliance with the Work Health and Safety Act 2012 (SA).
2.4 Use of bench press or squat racks without safety bars or devices is strictly prohibited during unmanned hours.
2.5 Members are responsible for inspecting equipment before use and reporting any damage or malfunction immediately.
2.6 Personal trainers not employed or authorised by YP Health and Fitness and are prohibited from conducting sessions on the premises.
3. Safety and Security
3.1 CCTV cameras are installed and operational throughout the gym for safety and security purposes. Footage is retained for a minimum of three (3) months in compliance with the South Australian Information Privacy Principles (IPPs).
3.2 Duress buttons and duress lanyards are available for emergency use. Members are encouraged to familiarise themselves with their locations and usage.
3.3 First Aid equipment is available within the gym premises. Members are required to report any incidents or injuries immediately, as per the Work Health and Safety Act 2012 (SA).
3.4 Sensor lighting is installed at the front of the gym for member safety.
3.5 Members are required to adhere to all posted safety guidelines and signage within the gym.
4. Health and Conduct
4.1 Members must ensure they are medically fit to undertake physical exercise. YP Health and Fitness is not liable for any injuries or health conditions arising from the use of its facilities.
4.2 Members are expected to maintain appropriate conduct and adhere to gym etiquette, including wiping down equipment after use and returning weights to their designated places.
4.3 Smoking, alcohol, and drug use are strictly prohibited on the premises.
4.4 Any blood spills must be reported immediately to staff or cleaned up by the member using the provided spill kits, following safe hygiene practices. Failure to comply may result in suspension or termination of membership.
4.5 Pregnant members are advised to consult their healthcare provider before engaging in physical activities and must inform the gym of their condition to ensure safety considerations.
4.6 Members with infectious diseases that may pose a risk to others are required to refrain from using the facilities until they are no longer contagious. This is in accordance with the South Australian Public Health Act 2011 (SA).
4.7 Members must dress in appropriate gym attire, including closed-toe shoes, while using the facilities.
4.8 Aggressive or inappropriate behaviour towards staff or other members will not be tolerated and may result in immediate termination of membership.
4.9 In the event of any injury, accident, or safety concern, Members are required to complete an incident report form immediately and submit it to YP Health and Fitness staff. Failure to do so may affect the resolution of any claims or concerns related to the incident.
5. Unstaffed Hours
5.1 The gym operates unstaffed during certain hours. Members access the gym during these times at their own risk, as per the Work Health and Safety Act 2012 (SA).
5.2 Members must not bring guests or non-members into the gym during unstaffed hours.
5.3 Any breach of the gym’s safety policies, including misuse of equipment, may result in immediate suspension or termination of membership.
5.4 Emergency contacts must be updated with the gym to ensure prompt assistance if needed.
6. Privacy and Data Handling
6.1 YP Health and Fitness collects and stores personal information, including CCTV footage and swipe pass records, in compliance with the Australian Privacy Act 1988 (Cth) and the South Australian Information Privacy Principles (IPPs).
6.2 Personal data is handled in accordance with these laws and used solely for safety and operational purposes.
6.3 YP Health and Fitness will not share members’ personal information with third parties unless required by law.
7. Cancellation and Refunds
7.1 For memberships paid via direct debit, the membership is locked in for the first eight (8) weeks. After this initial period, a fourteen (14) day notice period is required for cancellation.
7.2 Refunds will only be provided in accordance with the Australian Consumer Law and the Fair Trading Act 1987 (SA).
7.3 Any outstanding fees must be settled before a membership cancellation is processed.
8. Amendments
8.1 YP Health and Fitness reserves the right to amend these Terms and Conditions at any time. Members will be notified of significant changes via email or public notices within the gym.
8.2 Members are responsible for reviewing the updated Terms and Conditions and adhering to any changes.
9. Additional Provisions
9.1 Members are solely responsible for their personal belongings. YP Health and Fitness is not liable for any lost or stolen items.
9.2 The gym reserves the right to close temporarily for maintenance, repairs, or unforeseen circumstances. Members will be notified in advance where possible.
9.3 Members must adhere to the gym’s COVID-19 policies or any other health and safety measures implemented in response to public health concerns under the South Australian Public Health Act 2011 (SA).
9.4 YP Health and Fitness reserves the right to deny entry or membership renewal for any reason deemed necessary to ensure the safety and integrity of the facility.
10. Youth Membership Policy
10.1 Membership is available to individuals aged 15 years and older. A parent or legal guardian must cosign the membership agreement for members under 18 years of age.
10.2 Members aged 15 to 17 years are only permitted to access the gym during staffed hours. No after-hours access will be granted, regardless of adult supervision.
10.3 A medical and pre-exercise questionnaire must be completed by a parent or guardian for members under 18. Membership approval is at the discretion of YP Health and Fitness.
10.4 Members aged 15 to 17 years must complete a pre-exercise assessment with a qualified trainer before commencing exercise. Membership activation is subject to satisfactory completion of this assessment.
10.5 All members under 18 years of age must comply with directions given by YP Health and Fitness staff and trainers at all times. Failure to do so may result in suspension or termination of membership.
10.6 YP Health and Fitness reserves the right to review and amend these conditions at any time to ensure a safe training environment for all members.
11. Cooling-Off Period
11.1 A 7-day cooling-off period applies to all new membership agreements. During this period, you may cancel your membership and receive a full refund of any fees paid, minus reasonable costs for services already provided (e.g., personal training sessions attended).
11.2 To cancel within the cooling-off period, you must provide written notice to YP Health and Fitness via email.
11.3 Refunds will be processed within 10 business days of receiving your cancellation request.
11.4 The cooling-off period applies only to new memberships and does not extend to casual visit passes, short-term promotional memberships, or membership renewals.
12. Membership Pauses
12.1 All direct debit customers are eligible to request a pause for a maximum of 4 weeks during the term of their membership.
12.2 To request a pause, members must submit their request at least 7 days in advance.
12.3 Upon approval, the membership will be paused for the requested duration, and the membership term will be extended by the length of the pause at no additional cost.
12.4 Membership pauses are limited to a maximum duration of 4 weeks.
12.5 Pauses cannot be taken consecutively.
12.6 Membership pauses are subject to approval and may not be granted in all cases.

13. Photography and Media Release
13.1 By signing up for membership, you consent to the taking of photographs, videos, or other media during your participation in activities at YP Health and Fitness. These media may be used for promotional, marketing, or other business-related purposes.
13.2 If you do not wish to be photographed, please inform the staff prior to participating in any activities.
13.3 YP Health and Fitness will make reasonable efforts to honour requests for the removal of media, where feasible.
